Abstract

The increasing number of civil disputes in Indonesian courts reflects the complexity of legal relations in society, where lawsuits are the primary means for parties to seek justice. However, many lawsuits are drafted ambiguously, leading to the problem of obscuur libel (unclear lawsuit), which hinders fair and efficient dispute resolution. This study aims to analyze the concept and practice of ambiguous lawsuits in civil procedure law and their implications for dispute settlement, with a specific focus on case Number 145/Pdt.G/2025/PN.Mlg. The research employs a normative juridical method combined with an empirical approach, using statutory analysis, literature review, case documents, and field data from court practices. The findings reveal that unclear lawsuits often arise from inconsistencies in legal reasoning and the failure to differentiate between wanprestatie (breach of contract) and onrechtmatige daad (tort), causing lawsuits to be declared inadmissible and delaying justice for the parties. The discussion highlights the importance of legal clarity, judicial consistency, and procedural effectiveness to uphold legal certainty. This study suggests that greater precision in drafting lawsuits, coupled with judicial guidance and doctrinal consistency, is essential to ensure fair dispute resolution.
