Abstract

The phenomenon of revenge porn is a form of digital sexual violence that continues to rise in the age of information technology. The legal issue addressed in this research is the lack of adequate legal protection for victims of non-consensual dissemination of intimate content prior to the enactment of Law No. 12 of 2022 on Sexual Violence Crimes (UU TPKS). The research questions focus on: how legal protection is provided for victims of revenge porn in Indonesia and to what extent UU TPKS can offer legal certainty and recovery for victims. This study employs a normative juridical method, using statutory and case study approaches. Data was collected through legal document analysis, academic literature, and review of court decisions and relevant regulations. The findings show that prior to the enactment of UU TPKS, protection for victims of revenge porn relied mainly on the provisions in the Electronic Information and Transactions Law (UU ITE) and the Pornography Law, which did not comprehensively regulate aspects of recovery, psychological assistance, and the right to report without re-victimization. With the introduction of UU TPKS, regulatory strengthening occurred by defining electronic-based sexual violence, mandating victim recovery and assistance mechanisms, and imposing clearer criminal sanctions for perpetrators. The conclusion of this study is that UU TPKS is a more progressive legal instrument that advocates for victims of revenge porn. The researcher recommends widespread public dissemination of this regulation, improved capacity among law enforcement officers to understand digital sexual violence, and expanded access to psychological support services for victims.
