Abstract

The musical piece titled “Chauffeur,” which went viral on social media, was created by Artificial Intelligence (AI) without direct human creative involvement. Its creation process was highly fragmented, involving multiple parties in the form of data input, curation, and publication, without a single dominant actor who could be identified as the author. This situation raises significant legal issues in the Indonesian legal system, particularly because Law Number 28 of 2014 on Copyright explicitly recognizes only humans as legal authors. This study aims to analyze the copyright status of the music “Chauffeur” and examine the legal implications arising from the absence of a human legal subject in AI-generated works, especially in terms of legal certainty and copyright protection in the music industry. Using a normative legal research method and employing statutory, conceptual, and case approaches, the study finds that the lack of explicit regulation regarding AI-generated works leads to uncertainty in authorship attribution. Analysis of the direct human authorship theory, work made for hire, and new legal entity theory highlights the need for a more adaptive legal framework. The study concludes that the current positive law in Indonesia is not yet capable of accommodating works autonomously created by AI. The study recommends updating copyright regulations to reflect technological developments and the complexity of digital content production.
