Abstract

One of the criminal offences that has great potential to be resolved through Restorative Justice is assault, as regulated in Article 170 of the Criminal Code. Although classified as a crime against the body, in practice, assault often occurs in the context of social or emotional conflicts involving close relationships between individuals or groups. This study aims to examine the effectiveness of the application of Restorative Justice based on Peraturan Kepolisian No. 8 of 2021 in resolving criminal acts of assault at the Malang Police Headquarters. The research method used is empirical legal research with a socio-legal approach. The results of the study show that the Restorative Justice mechanism at the Malang Police Headquarters has been running in accordance with Police Regulations No. 8 of 2021, including eligibility assessment, penal mediation, peace agreements, and termination of investigations through SP3. This approach has proven to be faster, more efficient, and capable of restoring social relations between perpetrators and victims. Wider dissemination of the concept of Restorative Justice is needed so that the community's paradigm is not solely oriented towards retributive punishment.
