Abstract

This study delves into the juridical microcosm of Jalan Pisang Kipas, Malang City, a stage where two conceptions of truth stand in vis-à-vis confrontation, the normative truth of law (Das Sollen), manifested in the regulations concerning "speed bumps," which collides with the pragmatic truth of the community (Das Sein), born from the womb of empirical experience. Through a socio-juridical approach, this research reveals that the community's self-initiated initiative to construct speed bumps is not an anarchic act, but rather an existential response to reclaim a sense of security (salus populi suprema lex) that the state has failed to provide. A paradox is uncovered, wherein the completeness of legal substance is rendered impotent by the fragility of the pillars of legal structure and legal culture. The failure of the structure, namely the Malang City Transportation Agency in executing its educative function, is found to be a reflection of the institutional awareness deficit within the apparatus itself. The state's absence in its public outreach function creates a normative vacuum, compelling the community to construct its own legal order (living law) in response to state negligence. Consequently, the supremacy of formal law becomes merely a silent text, while social order is governed by the community's more grounded, pragmatic norms. This study concludes that this juridical divergence can only be bridged through a reconciliation between state law and community law, manifested through the proactive activation of the state's public education
