PENEGAKAN HUKUM OLEH KANTOR PERTANAHAN KABUPATEN MALANG UNTUK MENGENDALIKAN ALIH FUNGSI LAHAN PERTANIAN MENJADI NON PERTANIAN DI KABUPATEN MALANG (Studi di Kantor Pertanahan Kabupaten Malang)

This study aims to examine and analyze the role of the Land Office of Malang Regency, as well as the obstacles and efforts in controlling the conversion of agricultural land based on Article 44 paragraph (1) of Malang Regency Regional Regulation Number 6 of 2015 concerning Sustainable Agricultural Land Protection, and to evaluate the effectiveness of its implementation. The research method employed is a juridical-empirical approach supported by statutory, conceptual, and sociological approaches obtained through document studies and interviews with relevant officials. The results of the study show that the Land Office plays a strategic role through the issuance of land technical considerations, the alignment of land data with spatial planning policies, and its involvement in the FPR. However, the implementation of Article 44 paragraph (1) has not been fully effective due to no polygon zone, also low public awareness regarding the importance of agricultural land protection. Therefore, the role of the Land Office within the spatial planning forum is vital to ensure the achievement of sustainable agricultural land protection objectives.
