Abstract
The limitations of legal regulations regarding foreign refugees in Indonesia reflect one of the weaknesses in dealing with foreign refugees in countries that do not ratify and are not as transit countries for foreign refugees. The purpose of this research is to find out and explain how the responsibility of transit countries to foreign refugees is according to international law. The research method used in this study is a normative legal method. This study uses a qualitative descriptive approach that focuses on legislation on the responsibility of states parties to the convention and non-parties to the 1951 Refugee Convention, in addition to this study also uses a case approach regarding Rohingya refugees. The results of this study show that the responsibility of transit countries towards foreign refugees remains firmly rooted in international law through the principles of humanity and human rights. The existence of refugee protection in Indonesia is part of the implementation of human rights obligations, not solely the issue of immigration. It can therefore be concluded that although many transit countries are not parties to the 1951 Convention, they still have a moral and humanitarian responsibility to provide temporary protection for refugees. And basically refugee protection in Indonesia is not just an immigration issue, but part of the implementation of human values and constitutional obligations of the state, Indonesia continues to play an active role in maintaining regional stability and upholding the principle of non-refoulement as part of international humanitarian responsibility. For this reason, states to the convention must be more responsive in dealing with refugee problems by opening their territories to become a refuge for foreign refugees.
