Abstract
This thesis discusses the legal considerations used by judges in imposing criminal sanctions, based on an analysis of Decision Number 160/Pid.B/2020/PN.Lmg. The objective of this research is to understand how judges apply the principles of legality, justice, and humanity in the process of criminal sentencing. The research method employed is qualitative with a normative juridical approach, analyzing court decision documents as the primary data source. The findings show that the judge referred to the provisions of Article 340 of the Indonesian Penal Code in conjunction with Article 55 paragraph (1) point 2, which were proven legally and convincingly. However, there remains a need to emphasize humanitarian values and the principle of substantive justice when imposing sentences. This study recommends that judges consider more humane alternative punishments and take into account the defendant’s social conditions, so that the decision is not only legally fair but also socially constructive.
