Abstract
Livestock refers to animals that are kept and managed with knowledge of
their habitat, food, reproduction, and benefits. They are regulated and supervised
by humans, and specifically bred as a source of materials and services that are
useful for human life, according to Law No. 6 of 1967. The crime of livestock theft
is now considered one of the criminal acts that significantly harms and disturbs
the community. Farmers, who previously believed that livestock could be raised
simply, cheaply, and profitably, are now filled with anxiety and insecurity.
Livestock theft is classified as aggravated theft or a qualified theft offense, as
stipulated in Article 363 paragraph (1) point 1e of the Indonesian Penal Code
(KUHP). In Article 363 paragraph (1) point 1e of the KUHP, the element that
aggravates the theft is the inclusion of 'livestock.' This background motivates this
research, which was conducted at the Probolinggo Police Department. The
problem statement addresses how law enforcement by the police against livestock
theft offenders is carried out in Probolinggo and what challenges the police face
in enforcing the law against livestock theft in the Probolinggo Police jurisdiction.
The research approach used in this legal writing is a sociological juridical
approach, with a qualitative descriptive method for data analysis. The types of
data used in this legal writing are primary and secondary data. Based on the
research and discussion, it is concluded that law enforcement carried out by the
Probolinggo Police involves several stages, starting from reports/complaints,
investigation, examination, arrest, seizure, and detention. The challenges faced in
enforcing the law against livestock theft in the Probolinggo Police jurisdiction
include legal factors, regional factors, supporting infrastructure, and community
factors.
