Abstract
This research examines the mechanisms for resolving alleged acts of violence committed by police officers of the Malang City Police Resort against demonstrators, as well as the obstacles faced by the police in maintaining order during public protests. The study is motivated by the recurring incidents of repressive actions by law enforcement officers that potentially lead to human rights violations. The research employs a sociological juridical method with a descriptive qualitative approach, combining analysis of relevant legislation with field data collected through interviews with police representatives.
The findings indicate that the resolution of alleged violence is carried out through two main mechanisms. First, the internal mechanism, which includes disciplinary and ethical hearings within the Police Professional Code of Ethics Commission (KKEP) to evaluate moral and professional misconduct. Second, the external (criminal) mechanism, which follows the general criminal justice process as regulated under the Indonesian Penal Code and Law No. 2 of 2002 on the Indonesian National Police. However, the implementation of these mechanisms is often hindered by the lack of reports from victims, limited evidence, and the public’s negative perception of police neutrality.
This study emphasizes the importance of transparency and accountability in every stage of the resolution process to restore public trust in the police institution. Therefore, stronger supervision and enhanced professionalism among police officers are essential to ensure that the handling of demonstrations aligns with human rights principles and the rule of law.
