TINJAUAN PERTIMBANGAN HUKUM TERHADAP TERDAKWA BHARADA ELIEZER SEBAGAI PELAKU YANG BEKERJA SAMA (JUSTICE COLLABORATOR) DALAM PUTUSAN PENGADILAN NEGERI NOMOR 798/Pid.B/2022/PN.Jkt.Sel

This study examines the legal considerations of the panel of judges in granting Richard Eliezer Pudihang Lumiu Justice Collaborator status in District Court Decision No. 798/Pid.B/2022/PN.Jkt.Sel and its conformity with Supreme Court Circular Letter (SEMA) No. 4 of 2011. The research applies a normative juridical method with statutory and conceptual approaches through library research. The findings show that the sentence reduction was granted due to the defendant’s cooperative attitude, admission of guilt, remorse, young age, clean criminal record, and forgiveness from the victim’s family. The defendant was sentenced to 1 year and 6 months imprisonment, significantly lower than the 12-year demand, and was deemed to meet the principle of substantive justice. However, the absence of clear limits on sentence reduction for Justice Collaborators poses potential legal loopholes; thus, stricter regulations are needed to ensure legal certainty and fairness in future applications.
