“QUO VADIS PENANGANAN KORBAN PENYALAHGUNAAN NARKOTIKA OLEH BADAN NARKOTIKA NASIONAL BERDASARKAN PRINSIP KEADILAN RESTORATIF DAN PRINSIP PENEGAKAN HUKUM” (Studi Kasus Badan Narkotika Nasional Kota Batu)

Law has ideal and factual dimensions, as the term das sollen das sein. Law enforcement practices that occur in the field are often not in accordance with the principles of law, one of which is justice. Narcotics crime is one of the crimes that has the highest number of cases in Indonesia and only effective enforcement can solve it. This paper aims to find out, analyze, and evaluate the handling of victims of narcotics abuse by Badan Narkotika Nasional, especially Badan Narkotika Nasional Batu City, which is based on restorative justice theory and law enforcement theory. The method used in this writing is socio legal research with data collection techniques in the form of interviews and documentation. The conclusion of this writing is that the implementation of law enforcement against victims of narcotics abuse has been able to touch the essence of restorative justice, but in the process it has not been maximized considering that the elements of restorative justice have not been fulfilled as required in theory. On the other hand, the implementation of law enforcement against victims of drug abuse is considered ineffective because the legal culture within BNN Kota Batu is still very weak.
