Analisis Efektifitas Sanksi Pidana dalam Pelaksanaan Peraturan Daerah No. 21 Tahun 2011 Tentang Pengelolaan Persampahan/Kebersihan dan Pertamanan (Studi Kasus di Kota Banjarmasin)

The garbage problem in Banjarmasin City is becoming increasingly complex due to population growth, low public awareness, and a lack of garbage management facilities. Local Regulation No. 21 of 2011 concerning Garbage Management/Cleanliness and Parks in Banjarmasin City stipulates criminal sanctions in the form of imprisonment or fines for violators, but its effectiveness is still not optimal, as evidenced by the large number of cases of illegal garbage disposal. This study uses an empirical method with a sociological-legal approach, supported by primary data obtained through interviews with judges, the Environmental Agency, the Public Order Agency, and the community, and secondary data from regulations, official documents, and related literature to analyze qualitatively using a descriptive-analytical method by describing the facts found from the many violations of illegal garbage disposal that occur in the city of Banjarmasin. There are three factors that hinder the effective implementation of criminal sanctions in Local Regulation No. 21 of 2011 concerning Garbage Management/Cleanliness and Parks in the City of Banjarmasin, and there are four obstacles in law enforcement in Banjarmasin City against illegal dumping violations based on Local Regulation No. 21 of 2011 concerning Garbage Management/Cleanliness and Landscaping in Banjarmasin City to prevent illegal dumping violations.
