POLITIK PEMBENTUKAN RANCANGAN PERATURAN DAERAH PERLINDUNGAN DAN PEMBERDAYAAN PENYANDANG DISABILITAS DI KOTA MALANG

Purpose of this study is to analyse the effectiveness of the Malang City Council's role in the formulation of local regulations, including procedures, influencing factors, and their impact on local government governance and community participation. The Malang City DPRD plays an important role in the formulation of local regulations, but the effectiveness of its legislative function is still low, including in the case of the unfinished draft local regulation on disability. This is despite Law No. 8 of 2016 requiring the fulfilment of the rights of persons with disabilities through local regulations. This indicates a gap between regulation and implementation, making it necessary to examine the politics of the formulation of the draft local regulation on disability in Malang City.
This study uses a qualitative-descriptive approach to analyse the role of the Malang City Council in the formulation of the Draft Regional Regulation on the protection and empowerment of persons with disabilities. Primary data was obtained through interviews with council members, government officials, stakeholders, and observation of meetings and related activities, while secondary data was obtained from official documents such as draft regional regulations, reports, and meeting minutes. Data analysis was conducted inductively through transcription, coding, grouping, thematic analysis, and interpretation to identify patterns, issues, and the effectiveness of the DPRD's role. The research was conducted over four months, from 17 July to 31 November 2023, at the Malang City DPRD Office and its surroundings.
The results of the study show that the political process of formulating the Draft Regional Regulation on the Protection and Empowerment of Persons with Disabilities in Malang City includes problem identification, draft preparation, executive-legislative discussions, and DPRD decisions. The success of the draft regional regulation is influenced by effectiveness, efficiency, resource availability, and policy responsiveness. Periodic evaluations are necessary to ensure that the objectives of the legislation are achieved in accordance with the principles of justice and inclusion. Community participation through input, dialogue, and seminars is key to maintaining the legitimacy and sustainability of the policy.
