Abstract

This study explores the comparative criminal law framework concerning chemical castration sanctions for perpetrators of child sexual abuse in Indonesia and South Korea. The policy arises as a legal response to the increasing prevalence of child sexual crimes, aiming to establish deterrence and strengthen punitive protection. In Indonesia, chemical castration is regulated under Law Number 17 of 2016 and Government Regulation Number 70 of 2020 as an additional sanction imposed through a judicial decision. In contrast, South Korea enforces chemical castration under the 2020 Act on Pharmacologic Treatment of Sex Offenders’ Sexual Impulses with a distinct legal approach, including a longer duration of enforcement. This research employs a normative juridical method with a comparative legal approach. The findings indicate that although both countries differ in legal structure and procedural implementation, they share a common objective in prioritizing child protection through penal measures. Chemical castration in this context serves as a repressive tool aimed at preventing recidivism and ensuring justice for victims.
