PENEGAKAN HUKUM PADA TINGKAT PENYIDIKAN KASUS TINDAK PIDANA JUDI ONLINE TOTO GELAP BERDASARKAN PASAL 303 KUHP JUNCTO PASAL 27 AYAT 2 UU ITE DI POLRESTA BATU

The development of digital technology has fueled the widespread occurrence of online gambling crimes, particularly the type known as togel (illegal lottery), which is easily accessible to the public via the internet. This practice causes social unrest and negatively impacts the economic, psychological, and moral aspects of society. This study aims to examine the enforcement of criminal law against online togel gambling in the jurisdiction of Batu City Police (Polresta Batu) based on Article 303 of the Indonesian Criminal Code and Article 27 (2) of the Electronic Information and Transactions Law. The research uses an empirical juridical approach, with data collected through interviews with police officers and literature studies. The findings reveal that Polresta Batu has implemented legal procedures in accordance with prevailing regulations, including investigation, interrogation, and case referral to the prosecutor's office. However, challenges remain, such as difficulties in tracing gambling servers located abroad and complex digital transactions. Strengthening law enforcement technology, public education, and cross-agency collaboration are needed to effectively combat online gambling practices.
