Abstract
This study aims to identify the types of legal violations against songwriters' rights and the legal protections for songwriters regarding cover songs on social media. What are the ways in which legal violations against songwriters' rights are committed? How are legal protections for songwriters related to cover songs on social media regulated? This study uses the juridical-normative method, an approach that focuses on applicable legal norms or rules. In summary, legal violations of copyright can be subject to sanctions in accordance with applicable legal provisions, including criminal and civil penalties. Songwriters whose works are used without permission on social media are protected under the Copyright Law, which requires any party wishing to use another person's work to obtain prior permission. These violations may be subject to sanctions in accordance with applicable legal provisions, including criminal and civil penalties. The Ministry of Law and Human Rights and the National Collective Management Organization (LMKN) are the institutions authorized to oversee song/music copyright. The LMKN is authorized to collect, pool, and distribute royalties from songwriters or copyright holders. Songwriters are thus entitled to seek compensation for copyright infringement. Based on these conclusions, several recommendations can be made: increase public awareness of copyright; enforce stricter legal action against infringement; encourage collaboration between songwriters and digital platforms; require written agreements for song covers; and establish a non-governmental agency under the Ministry of Law and Human Rights that can monitor, regulate, and impose sanctions on song/music covers for social media, music events, and commercial use.
