Abstract

Defamation through social media is a form of legal violation committed intentionally by distributing, transmitting, or otherwise disseminating information or statements containing insults or accusations that attack a person’s name, honor, and reputation via the internet or social media, thereby making such information accessible to and known by the public, which may result in moral and even material losses for the victim. This research discusses the application of Article 27 paragraph (3) of Law Number 11 of 2008 on Electronic Information and Transactions in criminal acts of defamation, as examined in Decision Number 163/Pid.Sus/2021/PN.Mlg, and evaluates the extent to which the decision has fulfilled the principles of legal certainty, justice, and legal benefit. This study employs a normative juridical approach with a case decision analysis method. The research is expected to contribute to the development of criminal law, particularly concerning the application of relevant provisions in defamation cases in the digital era. It further recommends that legal policy should place greater emphasis on balancing legal certainty with victim protection, while also fostering a positive impact in creating a safer and more just digital space.
