ANALISIS YURIDIS SOSIOLOGIS PENYELESAIAN KECELAKAAN LALU LINTAS YANG MENGAKIBATKAN KORBAN MENINGGAL DUNIA (STUDI HUKUM KEPOLISIAN RESORT LOMBOK TIMUR)

Traffic accidents must be separated between violations and crimes, because in order to prosecute before the law, the incident that occurs must be a crime. While in traffic accidents, the crime that occurs is an unintentional crime or due to negligence or negligence. This study aims to determine the form of settlement of traffic violations that result in fatalities at the East Lombok Police Resort. The approach method used in compiling this legal writing is a sociological legal approach with the data analysis method in this study is Descriptive Analytical. The types of data used in writing this law are primary and secondary data. Based on the research results, it states that the process of resolving traffic accidents that cause fatalities is carried out through two channels, namely the legal channel (criminal justice process) and the non-legal channel in the form of deliberation or peace between the perpetrator and the victim's family. Normatively, in accordance with the provisions of Article 235 Paragraph (1) of Law Number 22 of 2009 concerning Traffic and Road Transportation, every traffic accident that causes fatalities must be followed up through a criminal process, without eliminating the perpetrator's obligation to provide assistance to the victim's heirs. However, in practice in East Lombok, resolution through deliberation or peace is more often used as the main means of resolving cases, and often eliminates the criminal aspect that should be carried out by prioritizing a family and peace approach compared to formal law enforcement.
