TINJAUAN YURIDIS PEMENUHAN HAK RESTITUSI ANAK KORBAN TINDAK PIDANA KEKERASAN SEKSUAL DITINJAU DARI PERSPEKTIF KEPASTIAN HUKUM (Studi Putusan Nomor 25/Pid.Sus/2023/PN.Lbh, Putusan Nomor 64/Pid.B/2023/PN.Blp, Putusan Nomor 686/Pid.Sus/2023/PN.Ptk)

This study aims to analyze the fulfillment of restitution rights for child victims of the crime of sexual intercourse based on Law Number 12 of 2022 concerning Sexual Violence Crimes. The main focus of this research is to examine the extent to which the courts accommodate the right to restitution as a form of legal protection for child victims, as well as to assess the consistency of the application of legal norms with the principle of legal certainty. This research uses a normative juridical method with a statute approach, case approach, and conceptual approach. Three court decisions are analyzed, namely Decision Number 686/Pid.Sus/2023/PN.Ptk, Decision Number 25/Pid.Sus/2023/PN.Lbh, and Decision Number 64/Pid.B/2023/PN.Blp. The results show that not all decisions accommodate the provision of restitution. This reflects the weak implementation of restitution provisions in judicial practice, which results in the non-fulfillment of the purpose of legal certainty from the perspective of the victim. Therefore, a stronger commitment from law enforcement officials is needed to uphold comprehensive and consistent legal protection.
