DISPARITAS PUTUSAN PEMIDANAAN PERKARA PEREDARAN NARKOTIKA DI INDONESIA DALAM MENCAPAI TUJUAN HUKUM MENURUT TEORI GUSTAV RADBRUCH (Studi Putusan Pengadilan Perkara Peredaran Narkotika di Pengadilan Negeri Mojokerto Tahun 2024)

Narcotics trafficking is a crime that has a serious impact on society and the state. The imposition of criminal penalties against perpetrators often causes disparities, namely differences in punishments in cases with similar legal characteristics. This study aims to examine the form of criminal disparity in the 2024 Mojokerto District Court decision, as well as analyze cases through Gustav Radbruch's theory of legal objectives. This theory was chosen
because it assesses law from three aspects of justice, certainty, and utility, in contrast to other legal theories that tend to focus on only one value. The method used is normative juridical with
a case approach. The results of the study show that there is a disparity in punishment, both in terms of the severity of the crime, the inconsistency in the application of the article, and inconsistent legal considerations. From the perspective of justice, the verdict has not reflected equal treatment. In terms of legal certainty, there are inconsistencies in the use of articles. Meanwhile, in terms of benefits, the deterrent effect on perpetrators has not been achieved
optimally. This study recommends the preparation of more systematic sentencing guidelines and the need for consistency in judges' considerations so that the values of justice, certainty,
and usefulness can be realized in a balanced manner.
