Abstract

The distribution of financing by BPR Sumberdhana Anda Tulungagung does not always proceed as expected, such as when debtors default and cause non-performing loans. This study aims to identify the factors causing debtor default in financing secured by fiduciary guarantees on motor vehicles, as well as the resolution of non-performing loans in credit distribution secured by fiduciary guarantees at BPR Sumberdhana Anda Tulungagung. The research method used is empirical juridical. The results of this study indicate that the factors causing debtor default include both internal and external factors. The resolution of non-performing loans at BPR Sumberdhana Anda Tulungagung is carried out through non-litigation means, namely negotiations between the debtor and the creditor. Non-litigation resolution is conducted through negotiations by inquiring about the debtor's difficulties in repaying the loan, which leads to restructuring efforts. The conclusion of this research is that the resolution of non-performing loans rarely proceeds to litigation in court; sometimes, a warning letter alone is enough to prompt the debtor to resume fulfilling their obligations. This study suggests that BPR should be more careful and thorough in analyzing prospective debtors during the credit disbursement process, and debtors are expected to take responsibility for fulfilling their obligations in financing.
