PELAKSANAAN PENDAFTARAN TANAH UNTUK PERTAMA KALI SECARA SPORADIK (STUDI DI KANTOR PERTANAHAN KABUPATEN TUBAN)

This study explores the implementation of sporadic initial land registration in Tuban Regency by the local Land Office (BPN). Tuban was selected due to the high number of uncertified land parcels and low public awareness of the importance of legal land ownership. The study aims to examine the registration process in accordance with Government Regulation No. 24 of 1997 and to identify the challenges encountered in its implementation. Using an empirical legal approach, the study reveals that although the process has a solid legal foundation including Government Regulation No. 24 of 1997 and No. 128 of 2015 numerous obstacles persist at the practical level. Administrative procedures such as document verification, land measurement, and certificate issuance often exceed the expected time frame, sometimes taking 6 to 12 months. The primary challenges include low legal literacy among the public, lack of valid ownership documents, negative perceptions of bureaucratic processes, and limited human resources. Furthermore, boundary disputes and ownership conflicts further hinder verification and measurement. In conclusion, while the sporadic land registration process in Tuban Regency follows the prescribed legal framework, its implementation remains suboptimal and has yet to reach all community segments. To address these issues, comprehensive legal education, stronger collaboration between village authorities and BPN, and enhanced transparency and accuracy in verification systems are essential to improve effectiveness and ensure legal certainty in land ownership.
