Abstract

This research explores the pros and cons of the implementation of chemical castration as a criminal sanction for perpetrators of sexual violence against children in Indonesia, viewed from the perspective of human rights. The study focuses on a normative analysis of Law Number 17 of 2016 and Government Regulation Number 70 of 2020 as the legal basis for the policy. The research employs a normative juridical approach with descriptive analysis, supported by a comparative study of chemical castration policies in several countries such as South Korea, the United States, and Poland. The findings reveal that chemical castration in Indonesia is regulated as an additional and mandatory punishment, yet its implementation faces numerous obstacles, including the absence of standard operating procedures (SOP), opposition from medical professionals, and suboptimal inter-agency coordination. From a human rights standpoint, chemical castration presents a dilemma between protecting victims and respecting the rights of offenders, particularly concerning the right to be free from torture and degrading treatment. Comparative studies show that other countries apply chemical castration through voluntary and rehabilitative approaches, accompanied by strict medical assessments and continuous supervision. This study recommends a revision of the regulatory framework to better uphold human rights principles, the formulation of detailed SOPs for implementation, and the strengthening of psychosocial rehabilitation programs for offenders as a more humane and effective penal approach.
