Abstract

The circulation of illegal alcoholic beverages near educational institutions in Malang City has become a serious issue, prompting the enactment of Regional Regulation No. 4 of 2020. This study aims to analyze the implementation of Article 8 paragraph (2) of the regulation and assess the effectiveness of its law enforcement in the field. This research employs an empirical legal method with a qualitative approach, using document analysis, and interviews. The urgency of this study lies in evaluating the extent to which local regulations can protect educational environments from the harmful effects of alcohol. The findings reveal that law enforcement has not been fully effective. Structurally, despite sufficient budget and technological support, the limited number of Civil Servant Investigators (PPNS) is a major obstacle. Administratively, many business operators lack proper licensing. Culturally, low legal awareness and minimal community participation further hinder enforcement efforts. These three factors structural limitations, weak legal culture, and low public involvement are interrelated and collectively obstruct the effective implementation of the regulation. Therefore, strengthening human resources, integrated data-based supervision, and continuous legal education are recommended to improve the effectiveness of law enforcement in a sustainable manner.
