Abstract

The development of information technology has brought positive and negative impacts on people's lives, including the increasing number of defamation cases through social media. This study aims to analyze legal protection for victims of defamation from the perspective of the Electronic Information and Transactions Law (UU ITE) and the Criminal Code (KUHP), as well as to examine the limits of freedom of expression according to positive Indonesian law. The research method used is normative juridical with a statutory approach and literature study. The results of the study show that defamation through electronic media has been explicitly regulated in Article 27A and Article 45A of the ITE Law, which provides more contextual protection than the Criminal Code which is still conventional. Although freedom of expression is guaranteed in the constitution, this right is limited by Article 28J of the 1945 Constitution and Article 70 of Law No. 39 of 1999 concerning Human Rights, to respect the rights of others and maintain public order. Therefore, a comprehensive understanding of the law and public awareness are needed so that freedom of expression is not misused as a tool for defamation.
