Abstract
Ownership of a decent residence is the right of every citizen as regulated in Article 28H paragraph (1) of the 1945 Constitution. To realize this right, the government forms a public housing savings program (Tapera) through Government Regulation Number 25 of 2020. This regulation causes polemic because workers can only follow one of the programs and the rejection of workers and employers, while employers are required to pay contributions for both. This study then gave rise to the problem formulation (1) The tapera program whether overlapping with the BPJS Employment program (2) regarding the principle of justice and the benefits in the housing supply policy for workers. This research is a normative legal research with the legislation and conceptual approach, which aims to analyze overlapping regulations between tapera and JHT-MLT and its impact on workers and employers. The results showed that this policy had not fully met the principle of justice and benefits because it increased the burden of contributions without guarantees optimal benefits. Therefore, it is necessary to evaluate the existence of the two programs to be chosen one of the most effective and unbudous housing provision mechanisms, as well as restoring the role of the state as a guarantee provider for the right to live for citizens.
