Abstract

This study discusses the role of law enforcement in addressing road
authorities who fail to repair damaged roads, which lead to traffic accidents,
particularly within the jurisdiction of the Malang City Police. Traffic accidents
caused by poor road conditions have become a serious issue, resulting in significant
losses to the public. Article 273 of Law Number 22 of 2009 on Road Traffic and
Transportation stipulates that road administrators who neglect road maintenance
may be subject to criminal sanctions. However, the enforcement of this article
remains limited due to the lack of effective legal action against the responsible
parties. This research adopts a socio-juridical method with a qualitative approach.
Data were obtained through interviews and the analysis of legal documents. The
findings indicate that the Malang City Police primarily focus on preventive and
repressive measures toward road users, while legal action against road authorities
has not been optimally implemented due to limited public reporting and
coordination barriers among institutions. This study recommends enhancing
coordination between law enforcement agencies and road administrators, as well
as raising public awareness about reporting accidents caused by damaged roads.
