Abstract

Illegal mining activities in Kutai Kartanegara Regency have continued to increase annually, despite the existence of clear legal frameworks such as Law Number 3 of 2020, which amends Law Number 4 of 2009 concerning Mineral and Coal Mining. This research aims to examine the effectiveness of law enforcement against illegal mining practices, identify influencing factors, and analyze the efforts undertaken by the Kutai Kartanegara Police Department in handling such activities. This research uses a sociological juridical method, utilizing interviews and document studies within the jurisdiction of the Kutai Kartanegara Police. The findings indicate that although regulations are in place and law enforcement actions have been taken, the overall effectiveness remains suboptimal. Key challenges include limited human resources, inadequate facilities and infrastructure, and low public legal awareness. Moreover, local cultural values and economic dependency also influence the community's participation in illegal mining. Therefore, strong collaboration among the government, law enforcement agencies, and the public is essential to suppress illegal mining practices and promote sustainable and equitable resource governance.
