Abstract

This study aims to analyze the differentiation in the provision of restitution to child victims of sexual violence. In this case, the decisions that are comprehensively analyzed are Decision Number 536/Pid.Sus/2019/PN Dps, Decision 1712/Pid.Sus/2021/PN Tng, Decision Number 989/Pid.Sus/2021/PNBdg, and Decision 16/Pid.Sus-Child/2022/Pn. Sbs This research uses a juridical-normative approach with a grammatical analysis method of the article description contained in Law 35 of 2014 concerning Amendments to Law 23 of 2002 concerning Child Protection. The results showed that the provision of restitution for child victims, especially for pregnant child victims in 4 decisions, has a different amount of restitution. In this case, the judge plays an important role in deciding when it is felt that the submission of restitution by LPSK is considered unfair. Considering that one of the ideal factors that must be considered in providing restitution includes the basis of medical and psychological analysis. The results of this study provide recommendations to the Supreme Court to formulate Supreme Court Regulations relating to nominal restitution indicators for child victims in order to provide more real justice for victims of sexual exploitation.
