Abstract

This thesis discusses the urgency of establishing an independent institution to implement personal data protection in Indonesia through a comparative study with Hong Kong. The research focuses on a comparative analysis of regulations and supervisory authority institutions, as well as their impact on the effectiveness of legal certainty. This research uses a normative juridical method with a statutory, comparative, and conceptual approach. The analysis is conducted through systematic and comparative interpretation of primary and secondary legal materials. In Hong Kong, the supervisory function is carried out by the PCPD, which is structurally and functionally independent, with full authority in supervision, investigation, sanctions, and public education. In contrast, in Indonesia, despite the existence of Law No. 27 of 2022, the supervisory institution has not been definitively established. The supervisory function is still temporarily carried out by the Ministry of Communication and Information Technology (Kominfo). The results of the study indicate that the absence of an autonomous institution leads to weak regulatory implementation and low public trust in the data protection system. Therefore, the establishment of an independent institution with a clear legal basis and strong authority is an urgent need to ensure the effectiveness of data protection and the fulfillment of citizens' constitutional rights
