Abstract

The lack of public awareness of the importance of legal compliance and understanding is the main cause of the low interest in obtaining legal protection, especially in terms of trademark registration for the products they produce. In today's era, the importance of registering trademarks must be very concerned by business people. Using empirical juridical research methods, the author will examine the Legal Awareness of MSEs Against the Importance of Trademark Registration in Wajak Subdistrict and to determine the impact of not registering the trademark of MSEs in Wajak Subdistrict. Based on the results of this study is the Legal Awareness of MSEs Actors Against the Importance of Trademark Registration in Wajak Subdistrict is classified as low, due to lack of knowledge about the trademark. There is only one MSE actor in Wajak Subdistrict who registered his trademark to the DJKI. Other MSE actors consider that they do not know how to register a trademark, feel it is not necessary, the cost is not in accordance with income or expensive, because there is already a business permit from NIB or PIRT and lack of socialization from the Office of Cooperatives and Micro Enterprises Malang Regency. The impact of not registering the trademark is not getting legal protection. Because the protection of rights to the trademark is based on the principle of First to File.
