PELANGGARAN HAK CIPTA ATAS TINDAKAN PEMBAJAKAN SIARAN OLAHRAGA YANG MENGGUNAKAN SISTEM PAY- PER-VIEW (PPV) DITINJAU DARI PERSPEKTIF HUKUM POSITIF DI INDONESIA

This study aims to examine piracy of pay-per-view sports broadcasts within the framework of positive law in Indonesia. It discusses the regulations governing piracy of pay-per-view sports broadcasts and the implications of Law Number 28 of 2014 on Copyright for such piracy. The research employs a normative juridical method with a systematic legal approach. The primary legal sources used in this study include Law Number 28 of 2014, Law Number 19 of 2016 amending Law Number 11 of 2008 on Electronic Information and Transactions (ITE), and Law Number 32 of 2002 on Broadcasting. The findings of this study indicate that while regulations on sports broadcast piracy exist in Indonesia, there are no specific provisions governing pay-per-view broadcasts. This act of piracy also infringes upon the rights of creators, violating both their economic and moral rights over their works.
