PERAN KEPALA DESA SEBAGAI MEDIATOR DALAM PENYELESAIAN SENGKETA WARIS MELALUI MEDIASI (Studi Kasus di Desa Pucung Lor Kecamatan Ngantru Kabupaten Tulungagung)

This research was conducted by the author to find out the role of the Village Head as a mediator in resolving inheritance disputes and also to find out the Village Head as an effective mediator in resolving inheritance disputes. Inheritance disputes are a problem that occurs in many rural areas, including in this case Pucunglor Village, Ngantru District, Tulungagung Regency. The inheritance dispute that occurred in Pucunglor Village began with a claim for inheritance rights over land that was sold unilaterally by one of the siblings. For this case, the Head of Pucunglor Village took the initiative to resolve the conflict. The initiative to resolve inheritance disputes was carried out at the Pucuglor Village Office. Furthermore, this study formulates two main problems, namely: 1) What is the role of the Village Head as a mediator in resolving inheritance disputes? 2) Is the Village Head as a mediator effective in resolving inheritance disputes? To be able to answer these problems, this research was carried out using the empirical legal research method. Then this research is also carried out through a sociological or juridical-sociological approach. The result of this research is to state that the Head of Pucunglor Village as a mediator has succeeded in resolving the inheritance dispute. This is certainly in accordance with the order of Article 26 paragraph (4) letter (c) of the Village Law. Also, the Head of Pucunglor Village as a mediator is not only supported by appropriate and appropriate legal products, but also supported by adequate facilities or infrastructure. This is in accordance with the theory of legal effectiveness developed by Soerjono Soekanto. The effectiveness of the law has a significant impact on the settlement of inheritance disputes that occur in Pucunglor Village.
