Abstract
Medical records are documents containing a collection of a patient's examination history. Traditionally, medical records have taken the form of paper sheets compiled into a health history book. With the times, the government has innovated to transform conventional medical records into a system called electronic medical records (EMR). This presents its own challenges for the government, particularly regarding the security of patients' personal data, which is a critical concern in an era of rampant cybercrime cases. This research aims to identify the forms of legal protection for personal data in the implementation of electronic medical records based on Minister of Health Regulation Number 24 of 2022 concerning Medical Records, and to analyze its alignment with Law Number 27 of 2022 concerning Personal Data Protection. The method used in this study is normative juridical, which focuses on the review of legal norms. The conclusion of this research is that while Minister of Health Regulation Number 24 of 2022 concerning Medical Records already provides forms of protection for the implementation of medical records, some aspects exhibit legal ambiguity, leading to a lack of alignment with the principles of personal data protection found in higher-level regulations, specifically Law Number 27 of 2022 concerning Personal Data Protection.The author recommends that revisions and adjustments be made to Minister of Health Regulation Number 24 of 2022 concerning Medical Records to align with the principles of personal data protection for electronic medical records. This is crucial considering that Minister of Health Regulation Number 24 of 2022 concerning Medical Records serves as the primary guideline for the implementation of electronic medical records.
