Abstract

This study analyzes the legal considerations in the Malang District Court Decision Number 353/Pid.Sus/2023/PN.Mlg concerning the case of Wahyu Kenzo, who committed licensing abuse in digital trading using the Auto Trade Gold (ATG) platform. The purpose of this research is to understand the judges’ legal reasoning in imposing criminal sanctions and to assess the decision in terms of legal certainty, justice, and utility. The research method used is normative juridical with statutory and conceptual approaches. The results indicate that the judge sentenced the defendant to 15 years of imprisonment and a fine of IDR 10 billion for violating Article 106 of the Trade Law, Article 55 of the Criminal Code, and Article 3 of the Money Laundering Law. This decision reflects firm law enforcement against digital economic crime perpetrators and provides legal certainty for the public, although evaluation is still needed regarding the effectiveness of licensing supervision and victim protection to achieve optimal substantive justice. This research is expected to serve as an academic reference in strengthening economic criminal law and enhancing public legal literacy in the era of digital trade.
