Abstract
In Indonesia, the legal circulation of narcotics is regulated under Law Number 35 of 2009 concerning Narcotics, which adopts a double-track system consisting of criminal sanctions and rehabilitation measures. This system aims to differentiate between addicts, users, and dealers. Rehabilitation is provided to users who are not involved in illicit drug trafficking based on assessment results during the investigation process. However, the effectiveness of rehabilitation implementation remains a problem, particularly at Class I Correctional Facility (Lapas Kelas I) Surabaya. Observations indicate that not all narcotics convicts receive rehabilitation, even though this is part of the objectives of the Narcotics Law. This issue is exacerbated by limited facilities and infrastructure, as well as an increase in the number of narcotics recidivists, which reflects the weak deterrent effect and poor rehabilitation outcomes.
This study uses an empirical juridical approach, with primary data obtained through interviews and observations at the Class I Correctional Facility in Surabaya, and secondary data consisting of laws and legal literature. The research aims to analyze the implementation of the double-track system for narcotics addicts at the Class I Correctional Facility in Surabaya based on Law Number 35 of 2009 concerning Narcotics. The results show that the implementation of the double-track system is still not optimal, both in terms of the regulation of social rehabilitation and the availability of supporting facilities. The low effectiveness of rehabilitation programs has led to a high rate of narcotics recidivism, indicating that the objectives of punishment — deterrence and recovery — have not been fully achieved. Therefore, collaboration among law enforcement agencies, as well as the strengthening of regulations and rehabilitation facilities, is needed to ensure that the double-track system is implemented in accordance with the law.
