ANALISIS YURIDIS PERLINDUNGAN HUKUM BAGI PEKERJA RUMAH TANGGA DITINJAU DARI ASPEK KEPASTIAN HUKUM

Domestic Workers are a group of workers who are vulnerable to exploitation and violence, so a law is needed that provides protection for domestic workers. This study discusses the urgency of the formation of the Draft Law on the Protection of Domestic Workers (RUU PPRT) in providing legal protection for domestic workers and the regulation of domestic worker protection in the Draft Law on the Protection of Domestic Workers reviewed from the aspect of legal certainty. The purpose of this study is to determine and examine the urgency of the formation of the RUU PPRT in providing legal protection for domestic workers and to analyze the regulations related to the protection of domestic workers in the RUU PPRT reviewed from the aspect of legal certainty. The research method used in this study is normative legal research with a legislative and conceptual approach. The results of this study are that the RUU PPRT is very urgent because there are no specific regulations that protect the rights of domestic workers. This bill is here to fill the legal vacuum and guarantee social justice by providing certainty of work status, wage protection, working hours, and dispute resolution. Although it shows progress in the legal recognition of domestic workers, this bill still leaves normative weaknesses, especially related to the definition of wages, working hours, and criminal sanctions. This legal vacuum can trigger legal uncertainty (rechtsonzekerheid) and even cause legal chaos (rechtverwarring). Therefore, improvements are needed so that the PPRT Bill becomes an effective and consistent protection instrument in the field, as well as being passed without further delay in order to guarantee legal certainty and protection for domestic workers.
