ANALISIS YURIDIS SOSIOLOGIS TERHADAP PENINGKATAN PERKARA PERCERAIAN DI KECAMATAN MUNCAR KABUPATEN BANYUWANGI (STUDI DI WILAYAH HUKUM PENGADILAN AGAMA BANYUWANGI)

This research aims to determine the factors that cause an increase in divorce cases in Muncar District, Banyuwangi Regency and the efforts of the Banyuwangi Religious Court in reducing the divorce rate in Muncar District, Banyuwangi Regency. The research method used is empirical juridical method or sociological legal research, with data analysis employing a descriptive approach. The findings of this study are as follows: First, there are 6 (six) factors that cause the increase in divorce rates in Muncar District, Banyuwangi Regency, namely economics factors, factors of continuous disputes and quarrels, domestic violence factors, factors of leaving one of the parties, factors of third party interference, and social media factors. These six factors are in accordance with the Explanation of Article 39 paragraph (2) of Law No. 1 of 1974 jo. Article 19 of Government Regulation No. 9 of 1975 jo. Article 116 of the Compilation of Islamic Law (KHI). Second, there are efforts made by the Banyuwangi Religious Court to minimize the occurrence of divorce, namely peaceful efforts or mediation in accordance with the provisions of PERMA No. 1 of 2016 and increasing the cost of divorce cases, which contradicts one of the principles of religious justice, namely the principle of simple, fast, and light costs. The result of this research are expected to inform that law enforcers can apply the principles that apply in marriage and the community can understand the applicable laws.
