Abstract

This study examines the legal protection for telemedicine patients who experience misdiagnosis under Indonesia's positive law. As telemedicine usage increases, concerns arise regarding diagnosis accuracy and legal accountability for doctors and telemedicine platforms. The absence of specific regulations exacerbates legal uncertainty for affected patients.The research problem centers on understanding the legal protection available for patients who suffer from misdiagnosis and identifying the factors that hinder its implementation. This study employs a normative juridical approach, analyzing laws, academic journals, and relevant literature.Findings indicate that current legal protections for telemedicine patients remain inadequate due to the lack of clear regulations addressing doctors' responsibilities in online consultations. While patients may file lawsuits through civil proceedings or the Medical Disciplinary Honorary Council of Indonesia (MKDKI), existing dispute resolution mechanisms remain ineffective.In conclusion, strengthening legal protection for telemedicine patients requires more comprehensive regulations. Recommendations include enhancing telemedicine laws, increasing oversight of online healthcare services, educating the public about their legal rights, and improving dispute resolution mechanisms to ensure patients receive justice more effectively.
