Abstract

The advancement of digital technology has led to various innovations in location-based applications, one of which is the Jagat application featuring the Coin hunt function. This feature encourages users to hunt virtual coins in real-world locations by following designated coordinates. In practice, several users have engaged in actions that resulted in the destruction of public facilities, such as city parks, fences, and government-owned property. This situation raises legal concerns regarding who should be held accountable for the resulting damage—particularly whether the application provider, as a corporation, can be held criminally liable. This study aims to analyze, from a juridical perspective, the potential for corporate criminal liability in connection with public facility damage caused by users of the Jagat application. The research employs a normative juridical method with statutory, theoretical, and case study approaches. The results show that criminal liability cannot be imposed on PT Jagat Teknologi Indonesia in this case, as the necessary elements of corporate criminal responsibility, as regulated by Indonesian Supreme Court Regulation No. 13 of 2016, are not fulfilled. There is no evidence that the corporation ordered, facilitated, negligently supervised, or directly benefited from the users’ unlawful conduct. Therefore, the actions committed by users are considered individual and fall outside the direct control of the corporation. Consequently, PT Jagat Teknologi Indonesia cannot be held criminally liable for the damage to public facilities. This research recommends the implementation of stricter preventive policies in managing applications that involve physical user activity in public spaces, to minimize the potential for negative social and legal impacts.
