TINJAUAN YURIDIS PEMBENTUKAN BADAN USAHA OLEH BANK TANAH BERDASARKAN PERATURAN PEMERINTAH NOMOR 64 TAHUN 2021 TENTANG BADAN BANK TANAH

A land bank is a special body which is an Indonesian legal entity established by the central government which is given special authority to manage land. As an implication of the realization of a land bank, Government Regulation Number 64 of 2021 concerning the Land Bank Agency and Presidential Regulation Number 113 of 2021 concerning the structure and organization of the land bank agency were established. Article 37 paragraph (1) of Government Regulation Number 64 of 2021 concerning the land bank provides an opportunity for land banks to form business entities. This study aims to analyze the legal provisions, mechanisms, forms, and types of business entities that can be formed by the Land Bank, as well as to identify obstacles in the formation of business entities. The main focus of the study is the ambiguity of norms in Government Regulation Number 64 of 2021, especially in Article 37 concerning the formation of business entities. The research method used is normative juridical, with a statutory and conceptual approach. Primary legal materials are in the form of laws and regulations, while secondary legal materials include legal literature and related journals. The results of the study indicate that there is incomplete regulation in the regulation of the establishment of business entities by the Land Bank, especially regarding the limitations, orientation, and legal certainty of the form of business entities that can be established. This study recommends the need for regulatory updates to provide regulatory clarity and legal certainty in the establishment of business entities by the Land Bank.
