Abstract

The Constitutional Court Decision Number 60/PUU-XXII/2024 opens up wider opportunities for small political parties and independent candidates. This study discusses the basis for the judge's legal considerations and analyzes its implications for Indonesian democracy, especially in increasing political participation and election inclusiveness. This study aims to examine the basis for the legal considerations used by the judge in deciding this case and its legal implications for the principles of democracy. The method used is normative legal research with a statutory and conceptual approach. The sources of legal materials used are primary legal materials and secondary legal materials, with legal material collection techniques for document studies and literature studies. The results of the study show that the Constitutional Court lowered the nomination threshold from 20%-25% to 6.5%-10% based on the population in the area. The Constitutional Court argued that the previous provisions limited political rights and did not reflect the principles of a more open democracy. Based on the results of the research and discussion, it is known that the Constitutional Court's decision brought important changes to the regional head election system, although supervision is still needed so that politics does not become too fragmented. Therefore, further regulations need to be provided to ensure that this policy runs well without reducing the quality of democracy and regional leadership.
