Abstract

Prostitution is a complex social phenomenon with detrimental consequences for individuals, society, and the nation. In Indonesia, prostitution is not explicitly prohibited in the Criminal Code (KUHP). This creates a legal vacuum in prosecuting prostitution users. This thesis aims to analyze the problematic aspects of the legal vacuum surrounding prostitution users in Indonesia. Research data is obtained from primary and secondary legal sources. The research results show that the legal vacuum regarding prostitution users in Indonesia leads to several problems, including weak law enforcement, huuman trafficking, human rights violations. Based on the research findings, it is concluded that the legal vacuum regarding prostitution users in Indonesia needs to be addressed immediately. One solution is to revise the Criminal Code to explicitly prohibit and punish prostitution users. In addition, preventive measures and rehabilitation programs should be implemented for women involved in prostitution
