Abstract
This study analyzes alternative sentencing for perpetrators of child sexual violence in Indonesia, particularly regarding the challenges of implementing chemical castration as regulated by Law Number 17 of 2016. The study aims to assess the effectiveness of existing penalties and explore alternative sentencing methods that could better reduce child sexual violence rates. The research employs normative legal research using a statutory approach and secondary data analysis in the form of legal studies. The findings reveal that since the enactment of the Child Protection Law, neither imprisonment nor chemical castration as additional punishments have reduced the number of child sexual crimes. Moreover, the implementation of electronic monitoring devices and rehabilitation has not been considered. To address this issue, a revision of the existing regulations is necessary, including increasing the minimum sentence, enforcing the death penaltyas as the main punishment, implementing electronic monitoring devices, and ensuring rehabilitation programs. The study concludes that the penalties within the Child Protection Law, including chemical castration, do not provide a significant deterrent effect, necessitating alternative sentencing measures. This research suggests that a comprehensive evaluation of the current penal policies is needed, along with the development of more effective preventive approaches to protect children from sexual violence. The proposed legal reforms include increasing the minimum sentence to 15 years compared to other countries, enforcing the death penalty as the main punishment, and mandating electronic monitoring devices to prevent legal loopholes resulting from endless clinical reassessments. These reforms are expected to reduce the occurrence of child sexual violence.
