Abstract
One of the important principles in a state of law is the principle of equality before the law, this is stated in the amendment to the 1945 Constitution article 27 paragraph (1), so it is the basis for all citizens to be treated equally before the law, therefore as a state civil apparatus that should have an important role in supervision and prevention, it is actually involved in online gambling cases. This is the background for the author to analyze the implementation of Article 52 of the Criminal Code in realizing the principle of equality before the law against unscrupulous employees of the ministry of communication and digital, and how legal and non-legal factors can affect the level of criminal sanctions in online gambling cases involving unscrupulous employees of the ministry of communication and digital. This research uses a normative juridical approach method, with an emphasis on the study of statutory regulations and literature review. In implementing Article 52 of the Criminal Code against the case is a necessity because the case has fulfilled the elements in Article 52 of the Criminal Code. And this research also confirms that in terms of legal factors the online gambling crime has a strong legal basis, from the Criminal Code or the ITE Law so that there is no reason for law enforcement officials or institutions not to take firm action against online gambling offenders. Meanwhile, in terms of non-legal factors, namely public pressure, the economic condition of the perpetrator, and the attitude of the perpetrator during the judicial process also have a big role in determining sanctions. So it needs strict supervision, community participation, and stricter law enforcement.
