EFEKTIVITAS KESIAPAN KANTOR PERTANAHAN MALANG RAYA DALAM PENCATATAN PERJANJIAN SEWA ATAS TANAH TERDAFTAR (Studi di Kantor Pertanahan Malang Raya)

This research is motivated by the readiness of the Malang Raya Land Office in recording lease agreements for registered land submitted by interested parties based on Article 127 letter B of the Regulation of the Minister of Agrarian Affairs and Spatial Planning/Head of the National Land Agency Number 16 of 2021 to provide legal certainty for the parties involved. The purpose of this study is to determine and analyze the effectiveness of the readiness of the Malang Raya Land Office in recording lease agreements for registered land. The research method used is sociological juridical, with data collection through interviews with authorized parties at the Malang Raya Land Office. The results of the study indicate that the effectiveness of the readiness of the Malang Raya Land Office in recording lease agreements is influenced by legal factors, law enforcement, facilities and infrastructure, society, and culture. However, the Malang Raya Land Office still does not meet the readiness in terms of facilities and infrastructure, because there is no choice of lease agreement recording services. In addition, community factors are also hampered by economic problems, where the preparation of a Lease Agreement Deed and recording a lease agreement require a lot of money. Meanwhile, cultural factors are hampered by the public's view that does not yet understand the importance of recording lease agreements, as well as the lack of socialization provided regarding the importance of recording lease agreements. The suggestion given is for the Malang Raya Land Office to immediately provide lease agreement recording services, as well as provide socialization to the public and Notaries. Through these steps, it is hoped that the recording of lease agreements can be implemented, and reduce the potential for disputes in the future.
