Abstract

This research aims to analyze juridically the application of the law to children who commit the crime of theft, which is also of course to find out how the judge's considerations in handling the case of children who commit the crime of theft in Decision Number 13/Pid.Sus-Anak/2021/Pn.Rbi. Judges as law enforcers who impose sentences against perpetrators of criminal acts, especially child offenders, judges are obliged to use the provisions in Law Number 11 of 2012 concerning the Juvenile Justice System and must also pay attention to all aspects whether based on juridical or non-juridical aspects. However, in fact in Decision Number 13/Pid.Sus-Anak/2021/Pn.Rbi which discusses the imposition of prison sentences for children who commit the crime of theft with aggravation, where in this decision the judge is considered to have not paid attention to the principle of the best interests for children as stated in the SPPA Law. The conclusion of this study is that judges must be able to be more optimal to pursue restorative approaches, coaching efforts and other efforts for children by prioritizing the principle of the best interests of children.
