ANALISIS EFEKTIVITAS PENYELESAIAN TINDAK PIDANA DENGAN RESTORATIVE JUSTICE PADA TAHAP PENYELIDIKAN DAN PENYIDIKAN DI WILAYAH HUKUM POLRES BATU

Restorative Justice is an alternative approach to resolving criminal cases, focusing on restoring relationships between perpetrators, victims, and the community rather than solely emphasizing punishment as in the conventional judicial system. This study aims to analyze the effectiveness of implementing Restorative Justice during the investigation and inquiry stages within the Batu Police jurisdiction. The research employs a juridical-sociological approach, utilizing data collection techniques such as interviews, observations, and document studies at Batu Police. The findings indicate that the implementation of Restorative Justice at Batu Police has been relatively effective in resolving minor criminal cases. The success of this approach is influenced by factors such as mutual agreement between victims and perpetrators, community involvement, and policy support from law enforcement based on Police Regulation No. 8 of 2021. However, several challenges remain, including a lack of public understanding of Restorative Justice, potential social pressure on victims, and limitations in enforcing agreed settlements. The study concludes that Restorative Justice can serve as an effective solution for resolving certain criminal cases while ensuring fairness for all parties involved. Recommendations are provided for law enforcement to enhance public awareness and strengthen monitoring mechanisms in the application of this approach to ensure more inclusive and sustainable justice.
