KAJIAN YURIDIS SOSIOLOGIS PEMBINAAN NARAPIDANA UNTUK MENCEGAH TINDAKAN RESIDIVIS (STUDI DI LEMBAGA PEMASYARAKATAN PEREMPUAN KELAS II A MALANG)

Lapas sebagai salah satu lembaga sistem peradilan pidana memiliki tugas untuk melaksanakan pembinaan, selain itu pelaksanaan pembinaan tersebut sebagai upaya untuk mencegah tindakan residivis. Maka, Lapas Perempuan Kelas II A Malang melaksanakan pembinaan narapidana tersebut. Tujuan penelitian ini adalah guna mengetahui efektifitas pelaksanaan pembinaan narapidana untuk mencegah residivis serta fakor-faktor yang menjadi pendorong dan penghambat pelaksanaannya. Metode penelitian menggunakan pendekatan yuridis sosiologis dengan teknik analisis data deskriptif kualitatif. Data yang digunakan terdiri dari data primer yang diperoleh wawancara, observasi, dan dokumentasi serta data sekunder berasal dari berbagai literasi dan dokumentasi terkait. Hasil penelitian menunjukkan bahwa model pembinaan narapidana dilaksanakan sesuai dengan Undang-Undang Nomor 22 Tahun 2022 Tentang Pemasyarakatan, namun kesesuaian tersebut tidak maksimal dalam mencegah tindakan residivis karena adanya fakta masih ada 44 narapidana residivis dari total 405 narapidana. Kemudian dari hasil penelitian ini pelaksanaan pembinaan di Lapas Perempuan Kelas II A Malang belum efektif, berdasarkan analisis menggunakan teori sistem hukum oleh Lawrence M. Friedman yaitu pada aspek kultural.

Prisons as one of the institutions of the criminal justice system have the task of carrying out guidance, in addition to the implementation of the guidance as an effort to prevent recidivism. Therefore, the Class II A Women's Prison in Malang carries out the guidance of these prisoners. The purpose of this study was to determine the effectiveness of the implementation of prisoner guidance to prevent recidivism and the factors that drive and inhibit its implementation. The research method uses a sociological juridical approach with qualitative descriptive data analysis techniques. The data used consists of primary data obtained from interviews, observations, and documentation as well as secondary data from various related literature and documentation. The results of the study indicate that the prisoner guidance model is implemented in accordance with Law Number 22 of 2022 concerning Corrections, but this conformity is not optimal in preventing recidivism due to the fact that there are still 44 recidivist prisoners out of a total of 405 prisoners. Then from the results of this study, the implementation of guidance at the Class II A Women's Prison in Malang has not been effective, based on the analysis using the legal system theory by Lawrence M. Friedman, namely in the cultural aspects.
